SUMMARY:
Actions against deceased defendants. Authorizes a personal representative to qualify solely for the purpose of defending a personal injury or wrongful death action. The personal representative has no duty to file an inventory or statement of accounts and is to be paid from the decedent's estate or, if none, from insurance proceeds the plaintiff recovers. Current law authorizes the circuit court to appoint an administrator if the defendant in these cases is a deceased nonresident and the administrator must account. No change is made to the procedure in these latter cases.
